Sexual Abuse Charges Under Arizona Law

In Arizona, sexual abuse is found under A.R.S. § 13-1404. Under this section, a person commits sexual abuse when they intentionally or knowingly:

  • Engages in a sexual encounter with anyone the age of 15 or older without their consent
  • With any person who is under the age of fifteen if the sexual contact involved only the female breast

Sexual abuse is a Class 5 felony, unless the victim was under the age of fifteen, in which case sexual abuse is a Class 3 felony offense, punishable pursuant to 13-705, Dangerous crimes against children. Under Section 13-705, any person at least 18 years of age who is convicted of a crime against children involving sexual abuse, shall be sentenced to 2 1/2 years, 5 years, or 7 1/2 years in prison.
