Sexual Abuse Charges Under Arizona Law
In Arizona, sexual abuse is found under A.R.S. § 13-1404.
A person commits sexual abuse when they intentionally or knowingly:
- Engage in a sexual encounter with anyone who is 15 or older without their consent; or
- With a minor who is under the age of 15 if the sexual contact involved only the female breast.
Sexual abuse is a Class 5 felony, unless the victim was under the age of fifteen, in which case sexual abuse is a Class 3 felony offense, punishable pursuant to 13-705, Dangerous crimes against children.
Under Section 13-705, any person who is at least 18 years of age who is convicted of a crime against children involving sexual abuse shall be sentenced to 2.5 years, 5 years, or 7.5 years in prison.
Sexual Abuse vs. Child Molestation Charges
Sexual abuse and molestation of a child are two distinct offenses, with molestation of a child involving sexual contact with (except for contact with the female breast) a child under the age of fifteen. If the child is under fifteen, the defendant faces 10 to 24 years imprisonment under A.R.S. § 13-1410.
