In an April 21, 2016 decision, the Arizona Court of Appeals, Division One, held that a defendant cannot be convicted of both aggravated DUI for DUI on a suspended license and aggravated DUI for not having an Ignition Interlock Device installed arising out of the same incident. The Court reasoned that, because the Ignition Interlock Device requirement is only invoked following reinstatement of a driver’s license, an individual with a suspended or revoked license cannot be convicted of aggravated DUI for failure to have an Ignition Interlock Device installed.
