Aggravated DUIs in Arizona

Drink and keysA driving under the influence charge can impact a number of aspects in your personal life. Did you know that there are other factors that can make a regular DUI charge an aggravated DUI? This means the penalties become harsher as the charges become a felony — class 4 or class 6 depending on the circumstances.

If you were pulled over, you should be aware of what acts would warrant an aggravated DUI charge. Keep in mind, these types of offenses come with penalties such as mandatory prison sentence, installation of an ignition interlock device, driver’s license revocation for 1 year minimum, and thousands of dollars in fines and fees.

Here are the four acts that could elevate a DUI charge to an aggravated DUI:

  • DUI while driving on suspended driver’s license (class 4 felony)
  • Third or subsequent DUI in 7 years (class 4 felony)
  • DUI with a minor 15 years of age or younger as a passenger (class 6 felony)
  • DUI while restricted by ignition interlock device (class 4 felony)

In an April 21, 2016 decision, the Arizona Court of Appeals, Division One, held that a defendant cannot be convicted of both aggravated DUI for DUI on a suspended license and aggravated DUI for not having an Ignition Interlock Device installed arising out of the same incident. The Court reasoned that, because the Ignition Interlock Device requirement is only invoked following reinstatement of a driver’s license, an individual with a suspended or revoked license cannot be convicted of aggravated DUI for failure to have an Ignition Interlock Device installed.
